In consideration of the current COVID-19 Public Health orders, prohibiting large public gatherings and requirements for physical distancing between persons, in-person attendance at this Special Town Council Meeting will be limited to Members of Council and essential Town Staff. This meeting will be held as an electronic meeting and is streamed live on the Town's website.

Confidential Staff Report 2021-0031: Litigation including matters before administrative boards and tribunals - Proposed Settlement, Triple Crown Line Developments Inc. - Verbal Update from Chris Barnett, Partner, Osler, Hoskin & Harcourt LLP.
 

Whereas, on December 17, 2020 Peel Regional Council passed by-law 83-2020 to change the composition of Regional Council by reducing Caledon’s representation by 40% or two seats;

Whereas, on December 23, 2020 Peel Regional Chair Nando Iannicca sent a letter to Minister Steve Clark advising him that the triple majority requirement needed to change the composition of Regional Council had been met;

Whereas, Peel Region is comprised of three area municipalities with the City of Mississauga having the majority of the seats on Regional Council;

Whereas, Peel Regional Council has exerted undo and unfair influence over Caledon planning matters in the past including overturning decisions by Caledon Council;

Whereas, it is important that Caledon have authority over local planning matters which include a robust public engagement process and compliance with Provincial planning policies;

Whereas, proposed Regional population and job forecasts illustrate a substantial amount of growth allocations to the Town of Caledon to 2051 (300,000 persons and 125,000 jobs);

Whereas, A Place to Grow: Growth Plan for the Greater Golden Horseshoe provides a framework for implementing growth in the Greater Golden Horseshoe to support the achievement of complete communities;

Whereas, the Growth Plan provides a separate chapter for Simcoe County, Simcoe Sub-Area Chapter 6, which enables the County to allocate population and employment forecasts and lower-tier municipalities to manage growth, including identification of areas for growth, and planning for and implementing policies for complete communities and employment lands ;

Whereas, the Town of Caledon seeks the Province’s support for a new Sub-Area Chapter for Peel/Caledon which would provide local municipalities with equality in control of local planning matters and the distribution of future growth allocations, including the determination of primary settlement areas, strategic employment areas and major transit station areas;

Therefore be it resolved, that the Province under Section 10 of the Places to Grow Act, 2005, develop a new Sub-Area Chapter for Peel/Caledon, or other power(s) as deemed appropriate, to protect the integrity of Caledon’s local planning process, and

That a copy of this motion be provided to the Honorable Minister Steve Clark, Ministry of Municipal Affairs and Housing, the Honorable Sylvia Jones, MPP Dufferin-Caledon and Nando Iannicca, Chair of the Regional Municipality of Peel.
