Delegation from Bruce Craggs regarding agenda item 10.1 Confidential Staff Report 2023-0447: Proposed or pending acquisition or disposition of land by the municipality or local board - Request to Purchase Brock Street Road Allowance, Ward 1 and item 10.2 Confidential Memorandum: Proposed or pending acquisition or disposition of land by the municipality or local board - Update regarding 2683894 Ontario Inc, 0 and 18319 Hurontario Street, Request to Purchase Brock Street Road Allowance

Whereas the employment of the Town of Caledon’s former CAO was terminated and the current CAO was appointed through the application of the “Strong Mayor Powers” as set out within the Strong Mayors, Building Homes Act, 2022;

Whereas the application of the "Strong Mayor Powers" meant that the Mayor alone, and without any involvement of Council, superseded the Town’s current hiring policy, recruitment and selection procedure, and salary administration procedure when she hired the new CAO;

Whereas providing information to Members of Council and the public on the details of public sector employment represents an important disclosure of information for the purposes of transparency and accountability, as reflected by the Public Sector Salary Disclosure Act, 1996 and the Municipal Freedom of Information and Protection of Privacy Act, 1990;

Whereas the Members of Council require such information to allow Council to exercise its duty of oversight to ensure good governance, being a key responsibility to the constituents of the Town;

Whereas Council recognizes that individuals have rights regarding the disclosure of information under the Municipal Freedom of Information and Protection of Privacy Act, 1990;

Whereas Council is of the opinion that there is a compelling public interest in the disclosure of the CAO’s employment contract and, for comparison purposes, the former CAO’s employment contract too;

Now therefore be it resolved that staff be directed to consult the Information and Privacy Commissioner of Ontario and internal / external legal counsel regarding the proper disclosure of CAO contracts and review the legal feasibility and risks of publicly releasing such information; 

Further that staff be directed to report back on this matter through a Confidential Session at the October 10, 2023 General Committee Meeting.

Whereas Bill 112, the Hazel McCallion Act, received Royal Assent on June 8, 2023, and sets the date of January 1, 2025, for the dissolution of the Region of Peel;

Whereas through the dissolution of the Region of Peel the Town of Caledon will become a single-tier municipality and managing this change effectively requires significant planning and implementation;

Whereas on July 5, 2023, the Province of Ontario announced appointments to the five member Peel Transition Board that is responsible for making recommendations to the government on a range of restructuring matters related to the dissolution of the Region of Peel to facilitate the transition to a single-tier municipality; 

Whereas the last update that Members of Council received on the transition process was at the July 11, 2023, General Committee Meeting which was held soon after the appointment of the Peel Transition Board;

Whereas the Members of Council have not been involved in planning the transition process, not been invited to meet with the Transition Board, not attended a briefing regarding next steps, timetables or workplans and have not received an update from the Mayor or staff regarding the activities and progress of the transition process;

Whereas the involvement of all of the Town's elected representatives in the transition process is crucial to advocate for and provide information to members of the public and Members of Council have received inquiries on the progress of the transition from constituents;

Now therefore be it resolved that the CAO be directed to bring forward an update to the October 10, 2023, General Committee Meeting to provide Members of Council and the public information on the progress of the Transition Board and work completed to date in support of the Town’s transition to a single-tier municipality; and

Further that the report brought forward by the CAO shall clarify the role that all Members of Council will take, in addition to the Mayor, to ensure all Members of Council are fully involved in assisting and informing the transition process through the coming months.

Whereas the Town of Caledon currently offers a Snow Removal Financial Assistance Program as an initiative from the Age-Friendly Caledon Action Plan to Low-income residents 65+ (receiving GIS) and Low-income residents with a physical disability;

Whereas last year several residents who required assistance did not meet the criteria due to the current eligibility requirements resulting in half of the expected applications;

Whereas the eligibility requirements must be expanded to include more Caledon seniors such as those who are 75+ and/or those who are widowed regardless of income status;

Now therefore be it resolved that staff be directed to further investigate expanding the eligibility requirements of the current Snow Removal Financial Assistance Program; and

Further that staff be directed to report back on this matter through a Staff Report at the November 7, 2023, General Committee Meeting.

Whereas growth and development may impact the sustainability of the urban forests and streetscapes;

Whereas 45 percent of the urban canopy in Peel Region is located on residential property; residents are therefore the most influential stewards of urban forests;

Whereas the urban forest provides health benefits by reducing local air pollution and playing an important role in climate change; 

Whereas several municipalities including Mississauga, Brampton, Guelph, Vaughan and Richmond Hill have implemented Urban Tree By-laws to protect urban trees from being removed;

Whereas in 2017, staff conducted a review of the feasibility of implementing an Urban Tree By-law and at that time, Council decided no to pursue the by-law;

Whereas in 2017, the Town has taken greater steps towards reducing the impacts of climate change and more recently adopted a Strategic Plan identifying Environmental Leadership as a priority area;

Now therefore be it resolved that staff investigate the feasibility of enacting an Urban Tree By-law to protect and sustain the urban forest within the settlement areas of the Town and report back in the first quarter of 2024.

Whereas the Village of Mono Mills is bisected by both Airport Road and Highway 9;

Whereas the section of Airport Road and Highway 9 through the Village of Mono Mills are bordered by residential, commercial, retail, a fire station, community parks, and a Bruce Trail crossing;

Whereas the volume and speed of car and truck traffic on Airport Road and Highway 9 continue to increase, which is negatively impacting the livability and overall pedestrian safety within the community;

Whereas the Highway Traffic Act permits the establishment of Community Safety Zones when public safety is of special concern;

Now therefore be it resolved that the Region of Peel and the Ministry of the Solicitor General Ontario be requested to establish Community Safety Zones along Airport Road and Highway 9, respectively, within the boundaries of the Village of Mono Mills;

That the Ministry of Transportation Ontario (MTO) be requested to reduce the speed limit from 80 km/hr to 60km/hr in both directions along Highway 9 within the boundaries of the Village of Mono Mills; and

That a copy of this resolution be forwarded to the Region of Peel, The Honourable Michael Kerzner, Solicitor General, The Honourable Prabmeet Sarkaria, Minister of Transportation, The Honourable Sylvia Jones, Deputy Premier and MPP Dufferin-Caledon, and Inspector MaryLouise Kearns, Detachment Commander, Caledon Detachment, Ontario Provincial Police.

Whereas Town Council, as the policy makers for the Municipality, play an important role in ensuring that projects and work are completed in a timely manner;

Whereas having a clear method for Members of Council and staff to track projects to ensure reporting back occurs as directed and on time is critical to maintaining accountability to Council, and transparency to the public;

Whereas the current methods for tracking the decisions of Council and reporting back is not comprehensive and does not provide clear information for Members of Council or staff;

Now therefore be it resolved that staff be directed to develop a new method and tool for tracking and managing the status and completion of Council decisions and bring forward an update to Council prior to the launch of the tool.

Whereas Ahmadiyya Muslim Jama’at  is hosting a charity run, Run for Caledon, on October 8, 2023 at the Humberview Turf Field and Track to raise funds for Caledon Community Services and Boys and Girls Club of Peel;

Whereas 100% of funds raised at the Run for Caledon will be directed to Caledon Community Services and Boys and Girls Club of Peel to further their services to the Caledon community;

Now therefore be it resolved that the rental fee, and picnic table fee of $980.00 (+ tax) be covered in kind grant for the duration of the event on Saturday, October 8th, 2023 and a financial grant of $161.31 for the portalet be made from the Corporate Grants Account.
