Presentation from Steve Burke, Manager, Strategic Policy Planning and Jamie Cook, Managing Partner, Planning and Land Economics, Watson and Associates Economists Ltd.

Whereas on January 17, 2022, Council received correspondence from the Rice Group that asked Council to give support to its request for a   Ministerial Zoning Order (MZO). Council referred this matter to staff to complete a report on this proposal. No staff report was completed nor was there a vote by Council on the MZO request;

Whereas on July 22, 2022, then Mayor Allan Thompson sent a letter, using Town letterhead, to then Minister of Municipal Affairs and Housing, Steven Clark, asking for a Minister’s Zoning Order (MZO) and signed the letter using the title, Mayor of Caledon;

Whereas on May 24, 2023, this action by Mayor Thompson was disavowed and repudiated by a vote of Council;

Whereas on September 9, 2022, Minister Clark issued  Ontario Regulation 483/22 (MZO )for this property despite having received no direction from Council and the lands subject to the MZO were increased from 370 acres to 502 acres;

Whereas Council and the public were only made aware of how the MZO for this property was acquired through a meeting on April 11, 2023, where it was revealed that “an individual was working with someone in the Ministry to bring forward this MZO.”;

Whereas on August 30, 2023, the Ontario Auditor General began an audit on the government's process for selecting and approving MZOs;  

Whereas on September 4, 2023, Minister Clark resigned after Ontario’s Integrity Commissioner released a report that found that Minister Clark had violated the Members’ Integrity Act;

Whereas on October 10, 2023, the Royal Canadian Mounted Police (RCMP) announced it had taken over the investigation of former Minister Clark’s actions from the Ontario Provincial Police;

Whereas, on October 23, 2023, the Minister of Housing and Municipal Affairs, Paul Calandra, announced that he is in the process of reviewing MZOs “to ensure that decisions we made were done in a manner that maintains and reinforces public trust”;

Now therefore be it resolved that until the investigations being undertaken by the Auditor General, the Minister of Housing and Municipal Affairs and the RCMP are completed, that Town of Caledon staff be directed to suspend/halt all planning approvals and site alteration permits for 12245 Torbram Road,  0 Torbram Road, and 12542 Airport Road Ward 3.

Whereas on April 28, 2022, the Region of Peel adopted its Official Plan and submitted it for approval by Minister of Municipal Affairs and Housing, Steven Clark;

Whereas in May 2022, a group of developers purchased lands north of Mayfield Road between Torbram Road and Bramalea Road that were designated “Prime Agricultural Area” and “Greenbelt: Natural Heritage System" in the Region of Peel Official Plan on Schedules D1 and B5. In addition, a portion of the lands were designated Employment Areas on Schedule E4 in the Region Official. Plan;

Whereas on June 28, 2022, Town of Caledon Council approved a Growth Concept for the Town that designated those lands as “Greenbelt” and “Employment Area”;

Whereas in September 2022, Minister Clark received a letter asking that lands near the Mayfield Golf Course be changed from a “Prime Agricultural Area” designation to a “Rural Land Area” designation and that lands be removed from the “Employment Area” designation in the Region Official Plan;

Whereas on November 4, 2022, the Government of Ontario announced its Greenbelt land changes;

Whereas on November 4, 2022, Minister Clark issued a Notice of Decision of the Region of Peel Official Plan, with 44 modifications;

Whereas in the Ministerial Notice of Decision issued on November 4, 2022, Schedules D1 and E4 of the Region of Peel Official Plan had been modified to re-designate the lands referenced in this motion within the Greenbelt from Prime Agricultural Area to Rural Lands, and remove the Employment Area designation;

Whereas the Ministerial Notice of Decision was inconsistent with the Town of Caledon Council endorsed Growth Concept for the lands referenced in this motion;

Whereas on September 4, 2023, Minister Clark resigned after an Integrity Commissioner report determined that he had violated the Members Integrity Act;

Whereas on October 23, 2023, Minister of Municipal Affairs and Housing Paul Calandra announced a plan to reconsider Ministerial modifications to the Region of Peel Official Plan after finding that decisions were not made “in a manner that maintains and reinforces public trust”;

Now therefore be it resolved that Council requests that the Minister of Municipal Affairs and Housing support the Region of Peel Official Plan and the Town of Caledon Growth concept for the lands referenced in this motion and that the Minister be requested to ensure that this is reflected in the final decision on the Region of Peel Official Plan.

Whereas on April 28, 2022, The Region of Peel adopted its Official Plan and submitted it for approval by Minister of Municipal Affairs and Housing, Steven Clark;

Whereas on June 28, 2022 Caledon Council approved a Caledon Growth Concept, which in most respects was consistent with the adopted Peel Official Plan, but had some key differences based on the principle of “Caledon planning Caledon”. A copy of the report was sent to Minister Clark requesting that he consider it in making his decision to approve the Peel Official Plan;

Whereas on Nov 4, 2022, Minister Clark issued a Notice of Decision of the Region of Peel Official Plan with 44 modifications;

Whereas in May 2023, Town of Caledon issued a draft of its Official Plan;

Whereas in August 2023, Town of Caledon issued a revised draft of its Official Plan;

Whereas the Caledon Growth Concept Plan adopted in June 2022 is inconsistent with the land use designations in the Region of Peel Official Plan as adopted in April 2022;

Whereas on October 23, Minister of Municipal Affairs and Housing, Paul Calandra, announced a plan to reconsider Ministerial modifications to the Region of Peel Official Plan and he gave municipalities 45 days to submit changes to official plans;

Whereas the Town has until December 7 to submit changes to the Minister;

Now therefore be it resolved that Council review the Caledon Growth Concept before the December 7 ministerial deadline and that Council approve any requests to the Minister for changes in land use designations in the Peel Official Plan within the Town of Caledon.
